Q: We purchased a home and have since discovered some issues that were not disclosed to us at the time of purchase. What are the requirements of the seller to let us know of any problems with the home?
A: Under Minnesota Law Statutes 513.52 through 513.60 the seller is required to disclose in writing any material facts of which the seller is aware that may adversely and significantly affect the buyer’s use and enjoyment of the property. When completing the disclosure statement the seller should complete the form and review the prior disclosures if available and any inspections they may have in their possession. If you feel the seller had certain knowledge about the property and failed to disclose it you may have a claim against the seller. You should find out the cost of correcting the defect and based upon that decide your course of action, if any. If you decide to pursue a claim you should seek proper legal advice.
